Photo Contest Rules

1. No purchase or payment necessary to enter or win.
2. Deadline for entry is September 30, 2005.
3. The competition is open to amateurs and professionals.
4. Entries may be color or black and white digital images. Images should be no larger than 800 by 600 pixels at 72 dpi. and must be submitted in .jpg format.
5. To enter, you must be at least 18 years of age. Chocolate Fountain Sales employees and their immediate family members are not eligible. The contest is not open to any company, or it's employees offering chocolate fountains for manufacturer, sale, or distribution.
6. All photos must be relevant to chocolate fountains in one of the following contest categories:
   • Best Chocolate Fountain Display
   • Chocolate Fountains and Brides & Grooms
   • Chocolate Fountains and Celebrities
   • Chocolate Fountains and Kids
   • Chocolate Fountains in Unusual Places
7. An individual or company may submit a maximum of 1 photo per category for a total of 5 photos.
8. Entries must be submitted by the original photographer. Do not submit a photo taken by someone other than yourself. You must be the sole owner of the copyright of any image submitted. Your submission of the photo and information form is your guarantee that you are the author and copyright holder of the photo.
9. Photographers retain the copyright to their photographs. By entering the contest, photographers agree to have their submitted photograph displayed on the ChocolateFountainSales.com website without any fee or other form of compensation, and agree that Chocolate Fountain Sales may display winning photos in a "past winners" photo gallery and in the Chocolate Fountain Sales "e-postcard" service, and may make and retain copies of the photograph for archival purposes. Posted photos will be subject to the Chocolate Fountain Sales website Terms & Conditions. Photos will be credited to the photographer/Company named in the entry form. Entries (including non-winning entries) may be selected for display or use in other ChocolateFountainSales.com web pages, without additional permission from the photographer. In the event that ownership of any photograph submitted to Chocolate Fountain Sales is contested in any manner, Chocolate Fountain Sales retains the discretion to disqualify that photograph and discontinue use of the photograph.
10. Minor digital enhancement is permitted, but images that have been significantly modified or appear unnatural will be disqualified. No watermarks, signatures, or copyright notices may be added to images. All images will be displayed with the photographer's/company's name. Adding or replacing elements in an image is not permitted.
11. Eligible entries will be judged by a qualified panel of judges selected by Chocolate Fountain Sales. Judging will be based on the following criteria, with each criterion to be given equal consideration: photographic quality, public rating, visual appeal, and appropriateness. In the case of a tie, tied entries will be judged based on entry with the highest score received for photographic quality.
12. Chocolate Fountain Sales is not responsible for computer system, hardware, software, or program malfunctions or other errors, failures, or delayed computer transactions or network connections that are human or technical in nature. Furthermore, Chocolate Fountain Sales is not responsible for: (i) lost, misdirected, misplaced, illegible, unintelligible, incomplete, or late entries or (ii) any act, failure to act, or delay regarding the transmitting or processing of entries. Chocolate Fountain Sales reserves the right, in its sole discretion, to cancel or suspend all or any portion of this contest without notice if factors beyond Chocolate Fountain Sales' control, including technical difficulties, disrupt or corrupt the fair or secure administration or operation of the contest. Void where prohibited. Chocolate Fountain Sales is entitled to interpret these rules as needed and its decisions are final. Chocolate Fountain Sales reserves the right to disqualify any entrant that Chocolate Fountain Sales has reason to believe is not the original work of entrant, or does not otherwise meet the contest rules. If a winner is disqualified or determined to be ineligible, an alternate winner will be selected using the same judging process/criteria described above. Alternate winners are subject to all requirements set forth in these Official Rules.
13. By participating in the contest, you agree to release and hold harmless Chocolate Fountain Sales and its employees, officers, affiliates, agents, and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest, including infringement of intellectual property rights. Chocolate Fountain Sales and its employees, officers, affiliates, agents, and advertising and promotional agencies assume no responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind arising in whole or in part from this contest.
14. Winners will be chosen (using the criteria outlined in Rule #11) on or about October 15, 2005 from all eligible finalist entries received and will be notified by phone or e-mail on or about October 20, 2005.
15. Prizes are not transferable and cannot be assigned, redeemed for cash, or substituted, except where indicated, but Chocolate Fountain Sales reserves the right to substitute prize with one of equal or greater value if prize becomes unavailable for any reason. Taxes on prizes are solely the responsibility of the winners.
16. Entries that fail to comply with the Official Contest Rules will be disqualified.
